AN ACT to amend the election law, in relation to the location of polling
sites for early voting in certain cities and towns
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (h) of subdivision 2 of section 8-600 of the
2 election law, as amended by chapter 781 of the laws of 2021, is amended
3 to read as follows:
4 (h) Polling places for early voting shall be located so that voters in
5 the county have adequate and equitable access, taking into consideration
6 population density, travel time to the polling place, proximity to other
7 early voting poll sites, public transportation routes, commuter traffic
8 patterns and such other factors the board of elections deems
9 appropriate; provided, however, that in cities and towns with a popu-
10 lation of more than fifty thousand but less than one hundred thousand
11 based on the latest federal decennial census, each such city and town
12 must have at least one early voting polling place within its boundaries,
13 and, to the extent practicable, if such cities or towns have public
14 transportation routes, such polling place shall be situated along such
15 transportation routes. The provisions of section 4-104 of this chapter,
16 except subdivisions four and five of such section, shall apply to the
17 designation of polling places for early voting except to the extent such
18 provisions are inconsistent with this section.
19 § 2. This act shall take effect immediately.
