AN ACT granting retroactive tier I membership in the New York state and
local employees' retirement system to Craig Hammer
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any other law to the contrary, Craig
2 Hammer, who was employed by the Village of Canajoharie from June 1, 1970
3 through September 4, 1970 and who, is currently a member of the New York
4 state and local employees' retirement system, who through no fault of
5 his own negligence, did not become a member of the New York state and
6 local employees' retirement system on June 1, 1970 when first employed
7 by the Village of Canajoharie shall be deemed to have been a member of
8 the New York state and local employees' retirement system on such date
9 he commenced such employment with such village, having tier 1 status,
10 provided that an application is filed with the state comptroller within
11 one year from the effective date of this act.
12 § 2. Any costs incurred as a result of the enactment of this act shall
13 be borne by the state of New York.
14 § 3. This act shall take effect immediately.
FISCAL NOTE.--Pursuant to Legislative Law, Section 50:
This bill would deem Craig Hammer, a former employee of the Village of
Canajoharie, to have become a member of the New York State and Local
Employees' Retirement System on June 1, 1970, thereby granting him Tier
1 status.
If this bill is enacted, we anticipate that there will be an increase
of approximately $2,000 in the annual contributions of the State of New
York.
In addition to the annual contributions discussed above, there will be
an immediate past service cost of approximately $130,000 which would be

borne by the State of New York. This estimate is based on the assump-
tion that payment will be made on March 1, 2010.
This estimate, dated January 9, 2009 and intended for use only during
the 2009 Legislative Session, is Fiscal Note No. 2009-93, prepared by
the Actuary for the New York State and Local Employees' Retirement
System.
