AN ACT to amend the state technology law, in relation to health care
proxy information on state agency websites
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The state technology law is amended by adding a new section
2 106-a to read as follows:
3 § 106-a. Health care proxy information. Any state agency, board,
4 bureau, authority, commission, division, or other governmental entity
5 performing a governmental or proprietary function for the state that
6 maintains a public website and has a significant public interaction in
7 the field of public health shall, in consultation with the office of
8 information technology services and the department of health, create a
9 link on their homepage to the health care proxy information on the
10 department of health's website. A state agency, board, bureau, authori-
11 ty, commission, division, or other governmental entity performing a
12 governmental or proprietary function for the state which determines that
13 creating such link would create a financial hardship or which do not
14 have a significant public interaction in the field of public health
15 shall be exempted from the provisions of this section.
16 § 2. This act shall take effect January 1, 2014.
