        Introduced  by  Sens. MURPHY, LAVALLE -- read twice and ordered printed,
          and when printed to be committed to  the  Committee  on  Education  --
          recommitted  to  the  Committee on Education in accordance with Senate
          Rule  6,  sec.  8  --  committee  discharged,  bill  amended,  ordered
          reprinted as amended and recommitted to said committee

        AN  ACT to amend the education law, in relation to reimbursement method-
          ologies for tuition
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Paragraph a of subdivision 4 of section 4405 of the educa-
     2  tion law, as amended by chapter 53 of the laws of 1990,  is  amended  to
     3  read as follows:
     4    a.  The  commissioner  [of  education]  and the commissioner of social
     5  services shall develop reimbursement methodologies for the  tuition  and
     6  maintenance  components  of  approved  private  schools  and special act
     7  school districts. The commissioner [of education], in consultation  with
     8  the  appropriate state agencies and departments, shall have responsibil-
     9  ity for developing [a]  reimbursement  [methodology]  methodologies  for
    10  tuition  which  shall  be  based  upon appropriate educational standards
    11  promulgated pursuant to regulations of the commissioner [of  education].
    12  The  commissioner  of  social services, in consultation with appropriate
    13  state agencies and departments, shall have responsibility for developing
    14  a reimbursement methodology for maintenance, pursuant to  section  three
    15  hundred  ninety-eight-a  of  the social services law and the regulations
    16  promulgated thereunder.
    17    § 2. This act shall take effect immediately.
