Enacts the "school security guard training enhancement act"; provides requirements for a specialized certification for school security guards, including, but not limited to, retired police officers; requires topics including, but not limited to, the role and responsibility of school security officers, school-related laws and liability, security awareness in the educational environment, mediation/conflict resolution, disasters and emergencies and dynamics of student behavior be covered in such training and program; provides that such specialized certification and training program shall be implemented and enforced by the department of criminal justice services, in consultation with the division of homeland security and emergency services, state police and local law enforcement.

AN ACT to amend the general business law, in relation to enacting the
"school security guard training enhancement act"
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new article
2 7-B to read as follows:

8 § 89-e-1. Short title. This article shall be known and may be cited as
9 the "school security guard training enhancement act".
10 § 89-f-1. Requirements for a specialized certification. School secu-
11 rity guards employed or contracted by a school in this state, including,
12 but not limited to, retired police officers that have been retired for
13 more than five years, shall obtain a specialized certification, in addi-
14 tion to the general security guard license required by article seven-A
15 of this chapter. Such specialized certification shall require the
16 completion of a school-specific training program, including, but not
17 limited to, role and responsibility of school security officers, school-
18 related laws and liability, security awareness in the educational envi-
19 ronment, youth mediation/conflict resolution, disasters and emergencies,

1 dynamics of student behavior and cultural awareness, restorative
2 justice, crisis prevention, and the Dignity for All Students Act (DASA).
3 § 89-g-1. Implementation and enforcement. 1. The specialized training
4 program shall be implemented and enforced by the department of educa-
5 tion, in consultation with the department of criminal justice services,
6 the division of homeland security, state police and local law enforce-
7 ment. Such training program shall be standardized and approved state-
8 wide.
9 2. The commissioner shall promulgate rules and regulations relating to
10 prior training and experience satisfying the training requirements of
11 the specialized certification.
12 3. The commissioner shall promulgate rules and regulations concerning
13 the period of time after this section becomes a law when the program
14 shall be implemented.
15 4. The commissioner shall, upon implementation of the certification
16 program, determine a period of time not to exceed one year that individ-
17 uals will have to obtain such certificate to continue serving as a
18 school security guard.
19 5. Nothing in this section shall supersede the language of any collec-
20 tively bargained agreement subject to article fourteen of the civil
21 service law. Any costs associated with this training, or leave time
22 required, shall be subject to a collectively bargained agreement under
23 article fourteen of the civil service law.
24 § 2. This act shall take effect on the one hundred eightieth day after
25 it shall have become a law.
