        Introduced  by  Sen. SANDERS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the public health law, in relation to  adding  dysmenor-
          rhea to the list of conditions covered for lawful medical use of mari-
          huana

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subparagraph (i) of  paragraph  (a)  of  subdivision  7  of
     2  section  3360 of the public health law, as amended by chapter 273 of the
     3  laws of 2018, is amended to read as follows:
     4    (i) having one of the following severe debilitating or  life-threaten-
     5  ing  conditions: cancer, dysmenorrhea, positive status for human immuno-
     6  deficiency virus or acquired  immune  deficiency  syndrome,  amyotrophic
     7  lateral  sclerosis,  Parkinson's  disease, multiple sclerosis, damage to
     8  the nervous tissue of the spinal cord with objective neurological  indi-
     9  cation  of intractable spasticity, epilepsy, inflammatory bowel disease,
    10  neuropathies, Huntington's disease, post-traumatic stress disorder, pain
    11  that degrades health and functional capability where the use of  medical
    12  marihuana is an alternative to opioid use, substance use disorder, or as
    13  added by the commissioner; and
    14    §  2.  This act shall take effect immediately, provided, however, that
    15  the amendments to section 3360 of the public health law made by  section
    16  one of this act shall not affect the repeal of such section and shall be
    17  deemed repealed therewith.
