        Introduced  by  Sen.  FUNKE  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Education
 
        AN ACT to amend the education law, in relation to  approval  of  capital
          improvement projects by the department of education
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 408 of the education law is amended by adding a new
     2  subdivision 7 to read as follows:
     3    7. a. The department  shall  complete  and  return  their  review,  in
     4  accordance  with the provisions of this section, of any locally approved
     5  capital improvement project within one hundred eighty days of  receiving
     6  a completed application.
     7    b.  For  the purposes of this section "capital improvement" shall mean
     8  (i) any physical public betterment or  improvement  or  any  preliminary
     9  studies and surveys relative thereto, or
    10    (ii) land or rights in land, or
    11    (iii) any furnishings, machinery, apparatus or equipment for any phys-
    12  ical  betterment  or  improvement when such betterment or improvement is
    13  first constructed or acquired, or
    14    (iv) any combination of subparagraphs (i),  (ii)  and  (iii)  of  this
    15  paragraph.
    16    § 2. This act shall take effect immediately.
