AN ACT authorizing Michael P. Koval to receive retirement service credit
for prior service
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any other provision of law, Michael P.
2 Koval, who was a police officer in the village of Watkins Glen, for the
3 period from September 6, 1988 through July 1, 1991, and who is currently
4 an officer with the city of Ithaca police department, and who is a
5 member of the New York state and local police and fire retirement
6 system, and who, for reasons not ascribable to his own negligence did
7 not receive service credit toward his optional 20 year retirement plan
8 for such period, shall be entitled to receive service credit toward such
9 plan for such period if, within one year from the effective date of this
10 act, he files a written request to that effect with the state comp-
11 troller.
12 § 2. All past service costs associated with the implementation of this
13 act shall be borne by the city of Ithaca.
14 § 3. This act shall take effect immediately.
FISCAL NOTE.--This bill will allow Police Officer Michael Koval,
currently employed by the City of Ithaca, to receive credit under the
provisions of Section 384-d of the Retirement and Social Security Law
for the period from September 6, 1988 through July 1, 1991 when he was a
police officer with the Village of Watkins Glen.
If this bill is enacted, we anticipate that there will be an immediate
past service cost of approximately $66,000, which will be borne by the
City of Ithaca as a onetime payment This estimate assumes a February 1,
2012 payment date.
This estimate, dated April 8, 2011 and intended for use only during
the 2011 Legislative Session, is Fiscal Note No. 2011-140, prepared by
the Actuary for the New York State and Local Police and Fire Retirement
System.
