Go to top STATE OF NEW YORK ________________________________________________________________________ 4784--A 2021-2022 Regular Sessions IN SENATE February 12, 2021 ___________ Introduced by Sen. MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the real property law, in relation to allowing acknowl- edgments and proofs by any officer in active service of the armed forces authorized to act as a notary The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The opening paragraph of section 300 of the real property 2 law, as amended by chapter 977 of the laws of 1962, is amended to read 3 as follows: 4 The acknowledgment or proof of a conveyance of real property situate 5 in this state, if made by a person enlisted or commissioned in or serv- 6 ing in or with the armed forces of the United States or by a dependent 7 of any such person, wherever located, or by a person attached to or 8 accompanying the armed forces of the United States, whether made within 9 or without the United States, may be made before any [commissioned] 10 officer in active service of the armed forces of the United States [with11the rank of second lieutenant or higher in the Army, Air Force or Marine12Corps, or ensign or higher in the Navy or Coast Guard, or with equiv-13alent rank] authorized to act as a notary in any [other] component part 14 of the armed forces of the United States. 15 § 2.
