Permits coverage under Child Health Plus to take effect retroactively to the first day of the month in which the application was submitted for children who meet the eligibility criteria, provided that the applicant for insurance submits a completed and signed application and required information and documentation within sixty days of the child's birth.

AN ACT to amend the public health law, in relation to retroactive
enrollment in the Child Health Insurance Plan
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (i) of subdivision 2 of section 2511 of the
2 public health law is amended by adding two new subparagraphs (iii) and
3 (iv) to read as follows:
4 (iii) A child who meets the eligibility criteria set forth in this
5 subdivision or subdivision five of this section, as determined by an
6 approved organization or the health insurance exchange marketplace,
7 whichever is applicable, shall be enrolled retroactively to the first
8 day of the month in which the application was submitted, provided that
9 the applicant for insurance submits a completed and signed application
10 and required information and documentation within sixty days of the
11 original application submission.
12 (iv) A child shall be presumed eligible for subsidy payments under
13 this subdivision or eligible for coverage under subdivision five of this
14 section, provided that the applicant for insurance submits a completed
15 and signed application within sixty days of the application submission.
16 Once eligibility is determined by the approved organization or the
17 health insurance exchange marketplace, whichever is applicable, on the
18 basis of preliminary information, the child shall be enrolled retroac-
19 tively to the first day of the month in which the application was
20 submitted. All other procedures and standards regarding presumptive
21 enrollment applicable to eligible children enrolled under this title and
22 specified in state contracts with approved organizations or implemented
23 by the health insurance exchange marketplace, whichever is applicable,
24 shall apply to presumptive enrollment of children.
25 § 2. This act shall take effect immediately.
