AN ACT to amend the retirement and social security law, in relation to
deductions for retiree organization dues
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 110-c of the retirement and social security law, as
2 amended by chapter 165 of the laws of 1993, is amended to read as
3 follows:
4 § 110-c. Deductions from benefits of certain retired members. 1.
5 Notwithstanding any other provision of law, a retired member shall have
6 the right, at any time after the retiree's retirement, to execute and
7 file a deduction authorization card with the comptroller authorizing the
8 deduction from the retired member's retirement allowance of membership
9 dues and such retired member's share of the cost for employee organiza-
10 tion-sponsored benefit plans and the payment thereof to a retiree organ-
11 ization of which the retired member is then a member and which is then
12 affiliated with either an employee organization certified or recognized
13 as the collective bargaining representative of all employees in the
14 negotiating unit of which the retired member was a part prior to his or
15 her retirement or with an employee organization with which such employee
16 organization is then affiliated. The comptroller shall thereafter deduct
17 from the retirement allowance of such retired member the amount of
18 membership dues and such amounts required to be paid by such retired
19 member for such authorized employee organization-sponsored benefit
20 plans, and shall transmit the sum so deducted to said retiree organiza-
21 tion. Such authorization shall continue in effect until revoked in writ-
22 ing by such retired member. For purposes of this section the term
23 "employee organization-sponsored benefit plans" shall include any and
24 all insurance plans and/or other benefit plans sponsored by such retiree
25 organization whether provided by (a) a not-for-profit corporation

1 licensed under article forty-three of the insurance law; (b) any insur-
2 ance company authorized to do business in this state; (c) a health main-
3 tenance organization issued a certificate of authority pursuant to arti-
4 cle forty-four of the public health law; or (d) a self-insurance
5 arrangement, welfare fund or benefit fund.
6 2. Notwithstanding any other provision of law, a retired member shall
7 have the right, at any time after the retiree's retirement, to execute
8 and file a deduction authorization card with the comptroller authorizing
9 the deduction from the retired member's retirement allowance of member-
10 ship dues in a not-for-profit membership organization of retired public
11 employees. The comptroller shall thereafter deduct from the retirement
12 allowance of such retired member the amount of membership dues and shall
13 transmit the sum so deducted to said retired organization. Such authori-
14 zation shall continue in effect until revoked in writing by such retired
15 member.
16 § 2. This act shall take effect immediately.
