        Introduced  by  Sen.  DUANE  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the public health law, in relation to  requiring  confi-
          dentiality  of  reports and information relating to tests for sexually
          transmissible diseases
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  2308-a  of  the  public health law is amended by
     2  adding a new subdivision 3 to read as follows:
     3    3. All reports or information secured  by  the  department,  municipal
     4  health  commissioner  or district health officer under the provisions of
     5  this title shall be confidential except:
     6    (a) insofar as disclosure is necessary to carry out the provisions  of
     7  this title;
     8    (b)  when  used in the aggregate, without patient specific identifying
     9  information, in programs approved by the commissioner for  the  improve-
    10  ment  of  the  quality of medical care provided to persons with sexually
    11  transmissible diseases; or

    12    (c) when used within the state or local health  department  by  public
    13  health  disease  programs  to  assess  co-morbidity  or  completeness of
    14  reporting and to direct program needs, in which  case  patient  specific
    15  identifying  information  shall  not  be  disclosed outside the state or
    16  local health department.
    17    § 2. This act shall take effect immediately.
