AN ACT to amend the education law, in relation to allowing cadets
enrolled at SUNY Maritime college to use scholarship money on any cost
associated with attendance
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions 2, 5 and 6 of section 352-a of the education
2 law, as added by section 1 of part F of chapter 83 of the laws of 2002,
3 are amended to read as follows:
4 2. (a) Maritime college shall have a total of two hundred eighty-four
5 vacancy positions set aside for applicants who are nominated by the
6 governor, a state senator or a member of the assembly. Such vacancy
7 nominations shall increase or decrease based upon the number of senate
8 districts authorized pursuant to article three of the New York state
9 constitution. An applicant who receives such a nomination, is accepted
10 for admission into the college and participates in the regimental
11 program shall receive a [tuition] scholarship equal to the amount of the
12 state tuition charge [after the deduction of any available grant aid]
13 for the four consecutive years following his or her admission into the
14 program provided, however, that the student remains in the
15 regimental/cadet degree program and remains at all times in good academ-
16 ic standing as determined by the maritime college administration. In no
17 event shall a student lose his or her scholarship based upon legislative
18 reapportionment or changes in legislative composition or membership.
19 Nothing herein shall be construed to limit or reduce the number of
20 vacancies available to the general population.
21 (b) To be eligible to receive such nomination and [tuition] scholar-
22 ship, the applicant must be a resident of the state. For purposes of
23 this section, a state resident shall be defined as a person who has
24 resided in the state of New York for a period of at least one year prior

1 to the time of nomination, is a graduate or within one year of gradu-
2 ation from an approved high school or has attained a New York state high
3 school equivalency diploma or its equivalent as determined by the
4 commissioner.
5 5. The [tuition] scholarships authorized by this section shall be made
6 available so long as funds are made available for such purposes.
7 6. Any individual receiving a [tuition] scholarship pursuant to this
8 section shall apply for all other available state, federal, or other
9 educational grant aid at the time of enrollment. Any grant aid or finan-
10 cial assistance received shall be utilized to offset the cost of tuition
11 to the maximum extent possible[, except that nothing shall require that
12 aid or assistance received which]. Maritime admissions scholarships may
13 be used towards educational costs other than that of tuition [shall be
14 applied toward the cost of tuition].
15 § 2. This act shall take effect immediately.
