        Introduced  by  Sen.  MARCELLINO  -- read twice and ordered printed, and
          when printed to be committed to the Committee on Transportation
 
        AN ACT to amend the vehicle and traffic law, in relation to  prohibiting
          the use of wearable computers while operating a motor vehicle
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. Paragraph (a) of subdivision 2 of  section  1225-d  of  the
     2  vehicle and traffic law, as added by chapter 403 of the laws of 2009, is
     3  amended to read as follows:
     4    (a) "Portable electronic device" shall mean any hand-held mobile tele-
     5  phone,  as  defined by subdivision one of section twelve hundred twenty-
     6  five-c of this  article,  personal  digital  assistant  (PDA),  handheld
     7  device  with  mobile  data  access,  laptop  computer,  pager, broadband
     8  personal communication  device,  two-way  messaging  device,  electronic
     9  game, [or] portable computing device or a computing device which is worn
    10  on  the  head  or other part of the body and projects visual information
    11  into the field of vision of the wearer.

    12    § 2. Paragraph (a) of subdivision 2 of section 1225-d of  the  vehicle
    13  and  traffic  law,  as  amended by section 8 of part C chapter 58 of the
    14  laws of 2013, is amended to read as follows:
    15    (a) "Portable electronic device" shall mean any hand-held mobile tele-
    16  phone, as defined by subdivision one of section twelve  hundred  twenty-
    17  five-c  of  this  article,  personal  digital  assistant (PDA), handheld
    18  device with  mobile  data  access,  laptop  computer,  pager,  broadband
    19  personal  communication  device,  two-way  messaging  device, electronic
    20  game, [or] portable computing device or a computing device which is worn
    21  on the head or other part of the body and  projects  visual  information
    22  into  the  field of vision of the wearer, or any other electronic device

    23  when used to input, write, send, receive, or read text  for  present  or
    24  future communication.
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    §  3. This act shall take effect immediately; provided that the amend-
     2  ments to paragraph (a) of subdivision 2 of section 1225-d of the vehicle
     3  and traffic law made by section two of this act shall take effect on the
     4  same date and in the same manner as section 8 of part C  chapter  58  of
     5  the laws of 2013 takes effect.
