        Introduced  by Sen. GRISANTI -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
 
        AN ACT to amend the vehicle and traffic law, in relation to  parking  in
          areas designated for charging electric cars
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 1205 to read as follows:
     3    § 1205. Parking spaces; charging plug-in electric cars. 1. It shall be
     4  a  violation for any person to stop, stand or park a vehicle in any area
     5  designated as a place for a plug-in electric vehicle to park and  charge
     6  unless  such vehicle is an electric vehicle that is plugged in and being
     7  charged.
     8    2. Except as otherwise provided by local law which  imposes  a  larger
     9  maximum  fine,  any person who stops, stands or parks in a space clearly
    10  marked for use by an electric vehicle in violation of subdivision one of
    11  this section shall be subject to a fine of not less than  fifty  dollars

    12  nor  more  than  seventy-five dollars for the first offense and seventy-
    13  five to one hundred fifty dollars for the second offense occurring with-
    14  in a period of two years within the same municipality. The arresting  or
    15  ticketing officer shall issue a summons to a violator of this section. A
    16  ticketing officer issuing a summons pursuant to this section may provide
    17  for  the  removal  and  storage  of  a motor vehicle illegally parked in
    18  violation of subdivision one of this section.
    19    § 2. This act shall take effect immediately.
