        Introduced  by  Sen. LAVALLE -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Local  Government  --

          ordered to a third reading, and to be reprinted as amended,  retaining

        AN ACT to authorize the Feed My Sheep Church to retroactively apply  for
          a  real  property  tax  exemption  for certain property in the town of
          Brookhaven, county of Suffolk
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any other provision of law to the contrary,
     2  the  assessor  of  the  town of Brookhaven, county of Suffolk, is hereby
     3  authorized to accept from the Feed My Sheep Church,  an  application  or
     4  renewal  application  for exemption from real property taxes pursuant to

     5  section 420-a of the real property tax law for the 2010-2011  assessment
     6  roll,  for  the  parcel  owned  by  such  not-for-profit church which is
     7  located at 495 Granny Road, Medford, New York,  11763  in  the  town  of
     8  Brookhaven, county of Suffolk, otherwise known as Suffolk county tax map
     9  0200-545.00-01.00-003.00. If accepted, the application or renewal appli-
    10  cation  shall  be  reviewed  as if it had been received on or before the
    11  taxable status date established for such rolls.
    12    If satisfied that such not-for-profit organization would otherwise  be
    13  entitled to such exemption if such not-for-profit organization had filed
    14  an  application  or renewal application for exemption by the appropriate
    15  taxable status date,  the  assessor  of  the  town  of  Brookhaven  upon
    16  approval by the Brookhaven town board, may grant exemption from taxation

    17  with  respect  to the subject rolls and may make appropriate corrections
    18  to the subject rolls. If such exemption is granted  and  such  organiza-

     1  tion,  therefore,  shall  have  paid any tax with respect to the subject
     2  rolls, the applicable governing body or tax department may, in its  sole
     3  discretion,  provide for the refund of those taxes paid and cancel those
     4  taxes, fines, penalties, liens, or interest remaining unpaid.
     5    § 2. This act shall take effect immediately.
