AN ACT in relation to the transportation of students in the Rochester
city school district
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. a. Notwithstanding the provision of any law, rule, or regu-
2 lation to the contrary, including subdivision 1 of section 3635 of the
3 education law, the city school district of the city of Rochester, upon
4 approval of a vote by the board of education of a plan which describes
5 fiscal and educational outcomes and implementation strategy and notifi-
6 cation to the commissioner of education by September 1, 2014, may enter
7 into a transportation pilot program for the 2014-2015 through 2016-2017
8 school years to provide transportation services at no more than one
9 school for all children attending grades kindergarten through eight who
10 live less than fifteen miles from a neighborhood school they legally
11 attend provided such transportation, if offered, shall be offered equal-
12 ly to all children in like circumstances residing in the district.
13 b. For the purposes of computing approved transportation expenses for
14 transportation aid for transportation provided under this pilot program,
15 expenses for transportation provided pursuant to this pilot program
16 shall be included. For 2014-2015 through 2016-2017 transportation
17 expenses shall be reimbursed pursuant to subdivision 7 of section 3602
18 of the education law in an amount not to exceed the 2014-2015 approved
19 transportation aid amount pursuant to such subdivision 7.

1 c. In the event costs for providing transportation for children that
2 would otherwise be aidable without this pilot program increase due to
3 enrollment changes or other customary increases in cost as defined in
4 regulation by the commissioner of education, the city school district of
5 the city of Rochester may apply to the commissioner of education for a
6 waiver to receive additional transportation aid in excess of the
7 2014-2015 transportation aid amount during the pilot program for
8 services that would otherwise be allowable transportation expenses.
9 d. The city school district of the city of Rochester shall provide a
10 report to the commissioner of education on the results of the first two
11 years of the pilot program, including data that describes the costs and
12 benefits of the program, by September 30, 2016.
13 § 2. This act shall take effect immediately and shall be deemed to
14 have been in full force and effect on and after July 1, 2014.
