        Introduced  by  Sen. SKOUFIS -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Local  Government  --
          committee  discharged,  bill amended, ordered reprinted as amended and
          recommitted to said committee -- reported favorably from said  commit-
          tee,  ordered  to first and second report, ordered to a third reading,
          passed by Senate and delivered to the Assembly, recalled, vote  recon-
          sidered,  restored  to  third  reading, amended and ordered reprinted,
          retaining its place in the order of third reading
 
        AN ACT alienating certain parklands in the town of Stony  Point,  county
          of  Rockland conveyed to said town pursuant to chapter 851 of the laws
          of 1973
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subject  to the provisions of this act, the town of Stony
     2  Point, in the county of Rockland, acting by and  through  its  governing
     3  body  and  upon  such terms and conditions as determined by such body is
     4  hereby authorized to discontinue as parklands and to alienate the  lands
     5  described  in section three of this act for the continued operation of a
     6  public golf course. The commissioner of general services shall  amend  a
     7  deed from the state to the town conveying the lands described in section
     8  three of this act, relating to the use of such lands, in order to permit
     9  the alienation authorized pursuant to this act.
    10    § 2. The authorization contained in section one of this act shall take
    11  effect  only upon the condition that the town of Stony Point shall dedi-
    12  cate an amount equal to or greater than the fair  market  value  of  the
    13  parklands  being  discontinued  towards the acquisition of new parklands
    14  and/or capital improvements to existing park  and  recreational  facili-
    15  ties.
    16    § 3. The parklands authorized by section one of this act to be discon-
    17  tinued as parkland are as follows:

     1    BEGINNING  at a point at the southeast corner of lands conveyed to the
     2  Town of Stony Point recorded in Book 81 of Patents at page  634,  thence
     3  the following fourteen (14) courses and distances:
     4    1) N 74°23'00" W a distance of 1017.36 feet to a point;
     5    2) N 08° 39' 27" W a distance of 817.69 feet to a point;
     6    3) S 81° 11' 33" W a distance of 957.57 feet to a point;
     7    4) S 00° 00' 00" E a distance of 493.17 feet to a point;
     8    5) S 90° 00' 00" W a distance of 100.24 feet to a point;
     9    6) N 00° 00' 00" W a distance of 863.57 feet to a point;
    10    7) S 90° 00' 00" W a distance of 900.00 feet to a point;
    11    8) N 00° 00' 00" W a distance of 917.21 feet to a point;
    12    9) S 50° 56' 41" E a distance of 530.56 feet to a point;
    13    10) N 03° 44' 23" E a distance of 221.85 feet to a point;
    14    11) S 75° 01' 30" E a distance of 2399.62 feet to a point;
    15    12) S 13° 14' 35" W a distance of 570.03 feet to a point;
    16    13) S 75° 24' 47" E a distance of 650.32 feet to a point; and
    17    14) S 14° 06' 25" W a distance of 795.62 feet to the point or place of
    18  beginning.
    19    Being  a  portion  of lands conveyed by the People of the State of New
    20  York to the Town of Stony Point recorded in the Department of  State  in
    21  Book 81 of Patents at page 634, dated January 29, 1974.
    22    CONTAINING 68.0 acres of land more or less.
    23    §  4.  In  the event that the town of Stony Point received any funding
    24  support or assistance from the  federal  government  for  the  purchase,
    25  maintenance  or  improvement of the parklands set forth in section three
    26  of this act, the discontinuance and alienation of such parkland  author-
    27  ized  by the provisions of section one of this act shall not occur until
    28  the town of Stony Point  has  complied  with  any  federal  requirements
    29  pertaining  to the alienation or conversion of such parklands, including
    30  satisfying the secretary of the interior that the alienation or  conver-
    31  sion  complies  with  all conditions which the secretary of the interior
    32  deems necessary to assure the  substitution  of  other  lands  shall  be
    33  equivalent in fair market value and usefulness to the lands being alien-
    34  ated or converted.
    35    § 5. This act shall take effect immediately.
