AN ACT to authorize the town of Ramapo, county of Rockland to file an
application for a real property tax exemption
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any other provision of law to the contrary,
2 the assessor of the town of Ramapo is hereby authorized to accept from
3 the town of Ramapo an application for exemption from real property taxes
4 pursuant to section 406 of the real property tax law for the 2008
5 assessment roll for the parcel owned by such town located in the town of
6 Ramapo at 7 Elm Street, otherwise known as section 50.17, block 2, lot
7 1. If accepted, the application shall be reviewed as if it had been
8 received on or before the taxable status date established for such roll.
9 If satisfied that such town would otherwise be entitled to such
10 exemption if it had filed an application for exemption by the appropri-
11 ate taxable status dates, the assessor of the town of Ramapo may upon
12 approval by the town board of such town, grant exemption from taxation
13 based on the 2008 assessment roll and owing by such town on the effec-
14 tive date of this act, and make appropriate correction of the subject
15 roll. If such exemption is granted and if such corporation shall have
16 paid any tax with respect to the subject roll, the governing body or tax
17 department may, in its sole discretion, provide for the refund of those
18 taxes paid and cancel taxes, fines, penalties or interest remaining
19 unpaid.
20 § 2. This act shall take effect immediately.
