        Introduced  by  Sen.  YOUNG  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
 
        AN ACT to amend the highway law, in relation to  directing  the  commis-
          sioner of transportation to prohibit use on any state or local highway
          with  a  speed  limit of forty-five miles per hour or more, of certain
          types of guardrails
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  10 of the highway law is amended by adding a new
     2  subdivision 47 to read as follows:
     3    47. Promulgate rules and regulations prohibiting the use and installa-
     4  tion, on any state or local highway having a speed limit  of  forty-five
     5  mils  per  hour  or more, of any "X-Lite" guardrail or rail cap manufac-
     6  tured by the Lindsay Corporation, or any other guardrail or rail cap  of
     7  similar design and/or materials as determined by the commissioner.
     8    § 2. This act shall take effect immediately.
