        Introduced by Sen. MARCHIONE -- read twice and ordered printed, and when

        AN ACT authorizing the county of Saratoga and the Saratoga County  Water
          Authority to transfer certain lands
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding section  219  of  the  county  law  to  the
     2  contrary,  the  county  of Saratoga, is hereby authorized, acting by and
     3  through its county board of supervisors and upon such terms  and  condi-
     4  tions as determined by such board of supervisors, to discontinue the use
     5  of  the  lands  described  in  section  three  of  this act acquired for
     6  reforestation purposes. The authorization contained in this act shall be
     7  effective only upon acquisition by the county of Saratoga of the  parcel
     8  as  described  in  section  four  of this act, which is currently vacant
     9  property not used  by  the  public  for  recreational  or  reforestation
    10  purposes, for reforestation purposes.
    11    §  2. Notwithstanding the failure of the county of Saratoga to seek or
    12  receive  state  legislative  authorization  to  alienate  certain  lands
    13  acquired  for  reforestation  purposes  as described in section three of
    14  this act prior to the use of such lands by  the  Saratoga  County  Water
    15  Authority,  such alienation is hereby validated, legalized, ratified and
    16  confirmed.
    17    § 3. The real property authorized to be  conveyed  by  the  county  of
    18  Saratoga pursuant to section one of this act is described as follows:
    19    All that parcel of land located in the county of Saratoga and state of
    20  New York bounded and described as follows:
    21    Commencing at a point at the intersection of the southeasterly bounda-
    22  ry  of Butler Road with the division line between the lands of The Sara-

     1  toga County Water Authority (Instrument No. 2008010290) on the south and
     2  the lands of Niagara Mohawk Power Corporation (Liber 333  Page  306)  on
     3  the  north,  said  point  being  marked by a capped iron rod labeled "CT
     4  Male";  thence  running generally in a southwesterly direction along the
     5  southerly bounds of Butler Road S56 -51'-55W (455.07) feet to the  POINT
     6  OF BEGINNING; thence from said POINT OF BEGINNING running generally in a
     7  southeasterly  direction  along  the  division line between The Saratoga
     8  County Water Authority (Instrument No. 2008010290) on the northeast  and
     9  the   County   of  Saratoga  (Liber  375  Page  429)  on  the  southwest
    10  S25 -36'-20W (1,230.00) feet to a point; thence running generally  in  a
    11  southwesterly  direction  through the lands of County of Saratoga (Liber
    12  375 Page 429) S64 -23'-40"W (180.00) feet to a point; thence running  in
    13  a generally northwesterly direction through the lands of County of Sara-
    14  toga  (Liber  375  Page 429) N25 -36'-20'W (1,234.62) feet to a point in
    15  the southerly bounds of Butler  Road;  thence  running  generally  in  a
    16  northeasterly  direction  along  the  southerly  bounds  of  Butler Road
    17  N65 -51'-55E (180.06) feet to the point or place of beginning;  contain-
    18  ing 5.092 acres of land, more or less.
    19    All as shown on a map entitled "Lot Line Adjustment Between the county
    20  of  Saratoga  (Tax  Map  No.  62-1-12.1)  and  the Saratoga County Water
    21  Authority (Tax Map No. 62-1-12.2)" dated July 20, 2014 and  prepared  by
    22  NMB Land Surveying PLLC.
    23    §  4.  The  authorization provided in section one of this act shall be
    24  effective only upon the condition that on or before the  alienation  and
    25  conveyance  of  lands described in section three of this act, the county
    26  of Saratoga shall acquire the following real property:
    27    All that parcel located in the county of Saratoga  and  state  of  New
    28  York bounded and described as follows:
    29    Commencing at a point at the intersection of the southeasterly bounda-
    30  ry  of Butler Road with the division line between the lands of The Sara-
    31  toga County Water Authority (Instrument No. 2008010290) on the south and
    32  the lands of Niagara Mohawk Power Corporation (Liber 333  Page  306)  on
    33  the  north,  said  point  being  marked by a capped iron rod labeled "CT
    34  Male"; thence running generally in a southeasterly direction  along  the
    35  division  line  of  The  Saratoga County Water Authority (Instrument No.
    36  2008010290) on the south and the lands of Niagara  Mohawk  Power  Corpo-
    37  ration  (Liber 333 Page 306) on the north S80 -05'-11"E (113.23) feet to
    38  a point marked by an iron pipe; thence running generally in a southeast-
    39  erly direction along the division line  of  The  Saratoga  County  Water
    40  Authority  (Instrument No. 2008010290) on the southwest and the lands of
    41  River Galusha, LLC (Liber 1784 Page 708) on the northeast  S25 -36'-20"E
    42  (1149.05)  feet  to  the  POINT  OF BEGINNING; thence from said POINT OF
    43  BEGINNING running generally in a southeasterly direction along the divi-
    44  sion line of River Galusha, LLC (Liber 1784 Page 708) on  the  northeast
    45  and  the Saratoga County Water Authority (Instrument No.  2008010290) on
    46  the southwest S25 -36'-20"E (370.00) feet to a point marked by a  capped
    47  iron  rod labeled "CT Male"; thence running in a generally southwesterly
    48  direction along the division line  between  The  Saratoga  County  Water
    49  Authority  (Instrument No.   2008010290) on the northwest and the County
    50  of Saratoga (Liber 375 Page 429) on the southeast S64 -23'-40W  (600.00)
    51  feet  to a point marked with a capped iron rod labeled "CT Male"; thence
    52  running in a generally northwesterly direction along the  division  line
    53  between  The Saratoga County Water Authority (Instrument No. 2008010290)
    54  on the northeast and the County of Saratoga (Liber 375 Page 429) on  the
    55  southwest  N25 -36'-20W  (370.00)  feet  to a point; thence running in a
    56  generally northeasterly direction through  the  lands  of  The  Saratoga
