AN ACT to amend the general municipal law, in relation to authorizing
the disposal of computers through donation to not-for-profit insti-
tutions for use by senior citizens or low income individuals
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 2 of section 104-c of the general municipal
2 law, as added by chapter 618 of the laws of 1998, is amended to read as
3 follows:
4 2. [Notwithstanding any other provision of law, the] The governing
5 board of a political subdivision may by resolution, adopt policies
6 authorizing the disposal of computers, computer software and computer
7 equipment no longer needed for the purposes of the political subdivision
8 through donation to public schools, public libraries, and other public
9 and private institutions for secular educational use, and to not-for-
10 profit institutions for use by individuals with disabilities, senior
11 citizens, or low income individuals, upon proof of need by such institu-
12 tion and subordinate to the requirements of the public schools and
13 libraries of the state. Such donation shall be based on a public notifi-
14 cation process and competitive proposals from schools, libraries, and
15 other public and private educational programs for secular education use,
16 and not-for-profit institutions serving persons with disabilities,
17 senior citizens, or low income individuals, which shall demonstrate need
18 and specific plans for the use of such equipment.
19 § 2. This act shall take effect immediately; provided, however that
20 the amendments to subdivision 2 of section 104-c of the general munici-
21 pal law made by section one of this act shall not affect the repeal of
22 such subdivision and shall be deemed repealed therewith.
