        Introduced  by  Sen.  LARKIN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
 
        AN ACT to amend the town law, in relation to establishing  an  exemption
          from  the residency requirement for volunteer members of the Pocatello
          fire district or the Washington Heights fire district, in  the  county

          of Orange
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 7 of section 176-b of the town  law,  as  sepa-
     2  rately amended by chapters 358, 378, 380 and 645 of the laws of 2008, is
     3  amended to read as follows:
     4    7.  The membership of any volunteer firefighter shall not be continued
     5  pursuant to subdivision five of this section, and persons shall  not  be
     6  elected  to  membership pursuant to subdivision six of this section, if,
     7  by so doing, the percentage of such non-resident  members  in  the  fire
     8  company  would  exceed forty-five per centum of the actual membership of
     9  the fire company, provided however, that the provisions of this subdivi-
    10  sion shall not apply to the memberships of the  Shelter  Island  Heights

    11  fire  district,  the  Cherry  Grove fire district, the Fire Island Pines
    12  fire district, the Davis Park  fire  department,  and  the  Cold  Spring
    13  Harbor  fire  district in Suffolk county, the New Hampton fire district,
    14  the Mechanicstown fire district, the Pocatello fire district, the  Wash-
    15  ington  Heights  fire district and the Good Will fire district in Orange
    16  county, the Jericho fire district and  the  Westbury  fire  district  in
    17  Nassau  county,  the  Orangeburg  fire  district in Rockland county, the
    18  South Lockport Fire Company  and  the  Terry's  Corners  volunteer  fire
    19  company  in  Niagara  County, the Taunton fire district and the Onondaga
    20  Hill fire department in  Onondaga  county,  the  Town  of  Batavia  fire
    21  department in Genesee County, the Schuyler Heights fire district and the
    22  Slingerlands  fire  district  I in Albany county, the town of Providence

    23  fire district in Saratoga county, the River Road fire district, No. 3 in

     1  Erie county or the  memberships  of  the  Millwood  fire  district,  the
     2  Purchase  Fire  District, the North Castle South Fire District, No. 1 in
     3  Westchester county, and the Thornwood fire company, No. 1 in Westchester
     4  county.
     5    § 2. This act shall take effect immediately.
