AN ACT to amend the New York state urban development corporation act, in
relation to energy conservation and efficiency projects
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3 of section 1 of chapter 174 of the laws of 1968
2 constituting the New York state urban development corporation act is
3 amended by adding a new subdivision 30 to read as follows:
4 (30) "Energy conservation and efficiency projects." A project or that
5 portion of a multi-purpose project designed and intended for the purpose
6 of reducing energy consumption and improving energy efficiency of build-
7 ing envelopes, building systems or manufacturing or industrial systems
8 by retrofitting or modernizing manufacturing, industrial or commercial
9 facilities. Energy conservation and efficiency projects may include, but
10 not be limited to: (a) energy audits performed by an energy auditor
11 approved by the New York state energy research and development authority
12 as defined in section eighteen hundred fifty-one of the public authori-
13 ties law; (b) insulation of the building structure or systems within the
14 building; (c) windows or doors, caulking or weather stripping, multi-
15 glazed windows or doors, heat absorbing or heat reflective glazed and
16 coated window or door systems, additional glazing, reductions in glass
17 area or other window and door system modifications that reduce energy
18 consumption; (d) automated or computerized energy control systems; (e)
19 heating, ventilating or air conditioning system modifications or
20 replacements; (f) replacement or modification of lighting fixtures to
21 increase the energy efficiency of the lighting system without increasing
22 the overall illumination of a facility, unless an increase in illumi-
23 nation is necessary to conform to the applicable state or local building
24 code or nationally accepted standards for the lighting system after the

1 proposed modifications are made; (g) energy recovery systems; (h) solar
2 energy generating or heating and cooling systems or other renewable
3 energy systems; (i) cogeneration or combined heat and power systems that
4 produce steam, chilled water or forms of energy such as heat, as well as
5 electricity, for use primarily within a building or complex of build-
6 ings; (j) energy conservation measures that provide long-term operating
7 cost reductions; and (k) maintenance and operation of mechanical systems
8 that provide long-term operating cost reductions.
9 § 2. This act shall take effect immediately.
