PALUMBO -- read once and referred to the Committee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee -- again reported from said committee with amendments, ordered reprinted as amended and recommitted to said committee AN ACT to authorize the Mattituck park district, in the town of Sout- hold, county of Suffolk, to discontinue use of certain lands as park- lands and sell such lands, and to use proceeds for capital improve- ments to existing park facilities in the Mattituck park district The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The Mattituck park district, in the town of Southold, coun- 2 ty of Suffolk, is hereby authorized to discontinue use of certain 3 district parklands more particularly described in section three of this 4 act which are no longer useful for district purposes, and sell and 5 convey such district parklands in fee simple for its fair market value 6 and upon such terms and conditions as it deems appropriate subject to 7 the provisions of section 4 of chapter 924 of the laws of 1941. 8 § 2. The authorization contained in section one of this act shall 9 take effect only upon the condition that the Mattituck park district 10 dedicate an amount equal to or greater than the fair market value of the 11 property being alienated in section three of this act toward acquisition 12 of additional parkland and/or capital improvements to existing parkland 13 within the district. The lands authorized by section one of this act to be discontin- 2 ued as parklands, and to be sold and conveyed are as follows: 3 ALL that certain plot, piece or parcel of land, situate, lying and 4 being at Mattituck, in the Town of Southold, County of Suffolk and State 5 of New York, being bounded and described as follows: 6 BEGINNING at a point on the southerly line of Pike Street at the 7 northwesterly corner of the premises herein described and running thence 8 along said southerly line of Pike Street, North 63 degrees 55 minutes 40 9 seconds E. 127.0 feet to land of now or formerly of John R. Monahan; 10 thence along said land now or formerly of John R. Monahan, South 25 11 degrees 52 minutes 20 seconds E. 201.67 feet to land now or formerly of 12 Conrad Grabie; thence along said land now or formerly of Conrad Grabie, 13 S. 67 degrees 37 minutes 40 seconds W. 22.0 feet to the land now or 14 formerly of Louis Dohm; thence along said land now or formerly of Louis 15 Dohm two courses, as follows: (1) N. 26 degrees 37 minutes 20 seconds 16 W. 19.1 feet; thence (2) S. 61 degrees 53 minutes 30 seconds W. 84.5 17 feet to the land now or formerly of William Wickham; thence along said 18 land now or formerly of William Wickham and land now or formerly of 19 Elberta Reeve, S. 76 degrees 3 minutes 10 seconds W. 75 feet to land now 20 or formerly of Kelsey; thence along said land now or formerly of Kelsey, 21 along land now or formerly of Lutz & Long, N. 21 degrees 28 minutes 20 22 seconds W. 88.9 feet to land now or formerly of William B. Reeve; thence 23 along the land now or formerly of William B. Reeve two courses, as 24 follows: (1) N. 63 degrees 55 minutes 40 seconds E. 40.0 feet; thence 25 (2) N. 21 degrees 28 minutes 20 seconds W. 80.0 feet to the point or 26 place of beginning, containing .6533 acre of land. 27 § 4. In the event the Mattituck park district received any funding 28 support or assistance from the federal government for the purchase, 29 maintenance or improvement of the parklands set forth in section three 30 of this act, the discontinuance and conveyance of parkland authorized by 31 the provisions of this act shall not occur until the Mattituck park 32 district has complied with any federal requirements pertaining to the 33 alienation or conversion of parklands, including satisfying the secre- 34 tary of the interior that the alienation or conversion complies with all 35 conditions which the secretary of the interior deems necessary to assure 36 the substitution of other lands shall be equivalent in fair market value 37 and recreational usefulness to the lands being alienated or converted. 38 § 5. This act shall take effect immediately.
