        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
 
        AN ACT to amend the village law, in relation to exempting  the  Buchanan
          Engine  Company No. 1 from the requirement that the percentage of non-
          resident fire department members not exceed forty-five percent of  the
          membership
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 7 of section 10-1006 of  the  village  law,  as
     2  amended  by  chapter  350  of  the  laws  of 2022, is amended to read as
     3  follows:
     4    7. The membership of any volunteer firefighter shall not be  continued
     5  pursuant  to  subdivision five of this section, and persons shall not be
     6  elected to membership pursuant to subdivision six of this  section,  if,
     7  by  so  doing,  the  percentage of such non-resident members in the fire
     8  company would exceed forty-five per centum of the actual  membership  of
     9  the fire company, provided however, that the provisions of this subdivi-
    10  sion shall not apply to the membership of the village of Blasdell volun-
    11  teer  fire  department,  provided  however,  that the provisions of this
    12  subdivision shall not apply to the membership of the village of Delanson
    13  volunteer fire company in the village of Delanson, county of  Schenecta-
    14  dy,  provided however, that the provisions of this subdivision shall not
    15  apply to membership of the village of Port  Dickinson  Fire  Department,
    16  within  the  village of Port Dickinson, Broome County, provided however,
    17  that the provisions of this subdivision shall not apply to  the  member-
    18  ship  of  the  village  of  Briarcliff Manor fire department, within the
    19  village of Briarcliff Manor, county of  Westchester,  provided  however,
    20  that  the  provisions of this subdivision shall not apply to the member-
    21  ship of the village of Ardsley volunteer  fire  department,  within  the
    22  village  of  Ardsley,  county of Westchester, provided however, that the
    23  provisions of this subdivision shall not apply to the membership of  the
    24  Buchanan Engine Company No. 1, within the village of Buchanan, county of
    25  Westchester.
    26    § 2. This act shall take effect immediately.
