        Introduced  by  Sen. PERALTA -- read twice and ordered printed, and when
          printed to be  committed  to  the  Committee  on  Rules  --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to said committee
 
        AN  ACT to amend the social services law, in relation to authorizing the
          payment of medical assistance for the provision of kidney  transplants
          for certain aliens
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 365-a of the social  services  law  is  amended  by
     2  adding a new subdivision 10 to read as follows:
     3    10. Notwithstanding the provisions of section one hundred thirty-one-k
     4  or  any  other  provision of this article, medical assistance shall also
     5  include payment for surgery, medical care and prescription drugs related
     6  to kidney transplantation for aliens with end-stage  renal  disease  who
     7  are  otherwise  eligible  for benefits pursuant to this title.  An alien
     8  shall only be deemed to be eligible pursuant to this subdivision  if  he
     9  or  she  has undergone emergency renal dialysis for a period of not less
    10  than two consecutive years within New York  state,  as  proven  by  such
    11  means  as  shall be designated in the regulations of the commissioner of
    12  health.
    13    § 2. This act shall take effect on  the  first  day  of  January  next
    14  succeeding  the  date  on  which  it  shall have become a law; provided,
    15  however, that effective  immediately,  the  addition,  amendment  and/or
    16  repeal  of  any  rule  or regulation necessary for the implementation of
    17  this act on its effective date is authorized and directed to be made and
    18  completed on or before such effective date.
