        Introduced  by  Sen. HOYLMAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Cultural Affairs, Tourism,

        AN ACT to amend the navigation law, in relation to  prohibiting  vessels
          from operating in navigable waters while equipped with a digital bill-
          board

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The navigation law is amended by adding a new section  43-a
     2  to read as follows:
     3    §  43-a. Use of digital billboards. 1. All vessels shall be prohibited
     4  from operating, anchoring or mooring in  the  navigable  waters  of  the
     5  state while equipped with a digital billboard that uses flashing, inter-
     6  mittent or moving lights.
     7    2.  As used in this section, the term "digital billboard" shall mean a
     8  one or two sided outdoor advertising sign that displays  digital  images
     9  which  are  changed  by  a computer in intervals and are used for either
    10  advertising or public service purposes.
    11    3. This section shall not apply to instances in which a local law  has
    12  been enacted pursuant to section forty-six-a of this part which express-
    13  ly authorizes vessels to use such digital billboards within one thousand
    14  five hundred feet off of its shore.
    15    4.  A  violation  of the provisions of this section shall constitute a
    16  misdemeanor and shall also be subject to a civil penalty of one thousand
    17  dollars for the first violation,  and  five  thousand  dollars  for  all
    18  subsequent violations.
    19    §  2.  This  act shall take effect on the ninetieth day after it shall
    20  have become a law.
