AN ACT to amend the education law, in relation to the requirements for a
license as a professional land surveyor; and providing for the repeal
of certain provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 7206-a of the education law, as added by chapter
2 987 of the laws of 1971, paragraph 3 of subdivision 1 and subdivision 2
3 as amended by chapter 32 of the laws of 1981, paragraph 6 of subdivision
4 1 as amended by chapter 133 of the laws of 1982 and paragraph 8 of
5 subdivision 1 and subdivision 3 as amended by chapter 62 of the laws of
6 1989, is amended to read as follows:
7 § 7206-a. Requirements for a license as a professional land surveyor.
8 1. To qualify for a license as a professional land surveyor, an appli-
9 cant shall fulfill the following requirements:
10 (1) Application: file an application with the department;
11 (2) Education: have received an education, including [a bachelor's] an
12 associate's or higher degree [based on a program] in land surveying, or,
13 an associate's or higher degree in engineering, math, or related science
14 with fifteen credits in land surveying, in accordance with the commis-
15 sioner's regulations;
16 (3) Experience: [(a) If the applicant has a bachelor's or higher
17 degree, have at least four years in work satisfactory to the board,
18 provided that the board may accept study beyond the bachelor's degree in
19 partial fulfillment of this requirement; or (b) If the applicant has an

1 associate's degree, have at least six years in work satisfactory to the
2 board provided that the board may accept study beyond the associate's
3 degree in partial fulfillment of this requirement] Have practical expe-
4 rience satisfactory to the department and in accordance with the commis-
5 sioner's regulations, provided that the department may accept study
6 beyond the associate's degree specified in paragraph two of this subdi-
7 vision in partial fulfillment of this requirement;
8 (4) Examination: pass an examination satisfactory to the [board]
9 department and in accordance with the commissioner's regulations;
10 (5) Age: be at least twenty-one years of age;
11 (6) Citizenship or immigration status: be a United States citizen or
12 an alien lawfully admitted for permanent residence in the United States;
13 (7) Character: be of good moral character as determined by the depart-
14 ment; and
15 (8) Fees: pay a fee of two hundred twenty dollars to the department
16 for admission to a department conducted examination and for an initial
17 license, a fee of one hundred fifteen dollars for each reexamination, a
18 fee of one hundred thirty-five dollars for an initial license for
19 persons not requiring admission to department conducted examination, and
20 a fee of two hundred ten dollars for each triennial registration period.
21 2. For admittance to the fundamentals of surveying examination, the
22 applicant shall fulfill the education, experience, and examination
23 requirements in accordance with the commissioner's regulations. Upon the
24 successful completion of the examination, an identification card as an
25 "intern land surveyor" shall be issued by the department. The fee for
26 examination qualification and identification card as an "intern land
27 surveyor" shall be seventy dollars.
28 2-a. In lieu of the degree and experience requirements specified in
29 subparagraphs [(2)] two and [(3)] three of subdivision one of this
30 section, eight years of practical experience in work satisfactory to the
31 [board] department may be accepted, provided that each full year of
32 college study in engineering or land surveying satisfactory to the
33 department may at the discretion of the [board] department be accepted
34 in lieu of one year of the required eight years of experience.
35 [3. For an identification card as an "intern land surveyor", an appli-
36 cant shall fulfill the requirements of subdivision one of this section,
37 except those in subparagraphs (3) and (5), provided that admission to
38 the examination may be given when the applicant is within twenty credits
39 of the completion of the requirements for the bachelor's or higher
40 degree as prescribed in subparagraph (2) of subdivision one, or has
41 completed the practical experience requirement of subdivision two of
42 this section. The fee for examination and identification card as an
43 "intern land surveyor" shall be seventy dollars and the fee for each
44 reexamination shall be seventy dollars.]
45 § 2. This act shall take effect eighteen months after it shall have
46 become a law; provided, however that subdivision 2-a of section 7206-a
47 of the education law, as added by section one of this act shall expire 8
48 years after such effective date when upon such date the provisions of
49 such subdivision shall be deemed repealed.
