AN ACT to amend the alcoholic beverage control law, in relation to oper-
ation of another business on a licensed farm manufacturing premises
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 31 of the alcoholic beverage control law is amended
2 by adding a new subdivision 14 to read as follows:
3 14. Notwithstanding any provision of law to the contrary, another
4 business or other businesses may operate on the licensed premises
5 subject to such rules and regulations as the liquor authority may
6 prescribe. Such rules and regulations shall determine which businesses
7 will be compatible with the policy and purposes of this chapter and
8 shall consider the effect of particular businesses on the community and
9 area in the vicinity of the farm meadery premises, provided however that
10 a retailer business licensed under this chapter shall not be permitted
11 to operate at a licensed manufacturing premises.
12 § 2. Section 51-a of the alcoholic beverage control law is amended by
13 adding a new subdivision 16 to read as follows:
14 16. Notwithstanding any provision of law to the contrary, another
15 business or other businesses may operate on the licensed premises
16 subject to such rules and regulations as the liquor authority may
17 prescribe. Such rules and regulations shall determine which businesses
18 will be compatible with the policy and purposes of this chapter and
19 shall consider the effect of particular businesses on the community and
20 area in the vicinity of the farm brewery premises, provided however that
21 a retailer business licensed under this chapter shall not be permitted
22 to operate at a licensed manufacturing premises.
23 § 3. Section 58-c of the alcoholic beverage control law is amended by
24 adding a new subdivision 15 to read as follows:

1 15. Notwithstanding any provision of law to the contrary, another

5 will be compatible with the policy and purposes of this chapter and
6 shall consider the effect of particular businesses on the community and
7 area in the vicinity of the farm cidery premises, provided however that
8 a retailer business licensed under this chapter shall not be permitted
9 to operate at a licensed manufacturing premises.
10 § 4. Subdivision 2-c of section 61 of the alcoholic beverage control
11 law is amended by adding a new paragraph (i) to read as follows:
12 (i) Notwithstanding any provision of law to the contrary, another
13 business or other businesses may operate on the licensed premises
14 subject to such rules and regulations as the liquor authority may
15 prescribe. Such rules and regulations shall determine which businesses
16 will be compatible with the policy and purposes of this chapter and
17 shall consider the effect of particular businesses on the community and
18 area in the vicinity of the farm distillery premises, provided however
19 that a retailer business licensed under this chapter shall not be
20 permitted to operate at a licensed manufacturing premises.
21 § 5. Section 76-a of the alcoholic beverage control law is amended by
22 adding a new subdivision 11 to read as follows:
23 11. Notwithstanding any provision of law to the contrary, another
24 business or other businesses may operate on the licensed premises
25 subject to such rules and regulations as the liquor authority may
26 prescribe. Such rules and regulations shall determine which businesses
27 will be compatible with the policy and purposes of this chapter and
28 shall consider the effect of particular businesses on the community and
29 area in the vicinity of the farm winery premises, provided however that
30 a retail business licensed under this chapter shall not be permitted to
31 operate at a licensed manufacturing premises.
32 § 6. This act shall take effect immediately; provided, however, that
33 section one of this act shall take effect on the same date and in the
34 same manner as chapter 522 of the laws of 2018, takes effect.
