        Introduced  by  Sen.  COMRIE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
 
        AN ACT to amend the real property tax law, in relation to making persons
          receiving a disability pension from the United States  Postal  Service
          eligible for the disability rent increase exemption program

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph a of subdivision 5 of section 467-b of  the  real
     2  property  tax law, as amended by section 1 of chapter 188 of the laws of
     3  2005, is amended to read as follows:
     4    a. To qualify as a person with a disability for the purposes  of  this
     5  section,  an  individual  shall  submit  to the appropriate rent control
     6  agency or administrative agency proof sufficient  to  such  agency  that
     7  such  individual  is  currently receiving (i) social security disability
     8  insurance (SSDI) [or], (ii) supplemental security income (SSI)  benefits
     9  under  the federal social security act [or], (iii) disability pension or
    10  disability compensation benefits provided by the United  States  depart-
    11  ment  of veterans affairs, (iv) disability pension or disability compen-
    12  sation benefits provided by the United States  Postal  Service,  or  (v)
    13  those  previously  eligible  by  virtue of receiving disability benefits
    14  under the supplemental security income program or  the  social  security
    15  disability  program  and currently receiving medical assistance benefits
    16  based on determination  of  disability  as  provided  in  section  three
    17  hundred sixty-six of the social services law.
    18    § 2. Paragraph a of subdivision 5 of section 467-b of the real proper-
    19  ty  tax law, as amended by section 2 of chapter 188 of the laws of 2005,
    20  is amended to read as follows:
    21    a. To qualify as a person with a disability for the purposes  of  this
    22  section,  an  individual  shall  submit  to the appropriate rent control
    23  agency or administrative agency proof sufficient  to  such  agency  that
    24  such  individual  is  currently receiving (i) social security disability
    25  insurance (SSDI) [or], (ii) supplemental security income (SSI)  benefits
    26  under  the federal social security act [or], (iii) disability pension or
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  disability compensation benefits provided by the United  States  depart-
     2  ment  of veterans affairs, (iv) disability pension or disability compen-
     3  sation benefits provided by the United States  Postal  Service,  or  (v)
     4  those  previously  eligible  by  virtue of receiving disability benefits
     5  under the supplemental security income program or  the  social  security
     6  disability  program  and currently receiving medical assistance benefits
     7  based on determination  of  disability  as  provided  in  section  three
     8  hundred sixty-six of the social services law.
     9    §  3.  This act shall take effect immediately; provided, however, that
    10  the amendments to subdivision 5 of section 467-b of  the  real  property
    11  tax  law made by section one of this act shall not affect the expiration
    12  and reversion of such section and shall expire and  be  deemed  repealed
    13  therewith, when upon such date the provisions of section two of this act
    14  shall take effect.
