AN ACT to amend the education law, in relation to limiting the use of
assessments administered to students in grades kindergarten through
grade two for diagnostic purposes
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 319 to
2 read as follows:
3 § 319. Kindergarten through grade two assessments; diagnostic
4 purposes. Notwithstanding any other provision of law or regulation to
5 the contrary, the commissioner shall prohibit the administration of
6 state developed assessment or other comparable assessments to students
7 enrolled in kindergarten, grade one or grade two that are being used for
8 anything other than diagnostic purposes. Provided further, school
9 districts' annual professional performance review plans shall use one of
10 the following options to comply with paragraph f of subdivision two of
11 section three thousand twelve-c of this chapter for teachers of students
12 enrolled in kindergarten, grade one or grade two: district, regional, or
13 BOCES developed assessments; school wide measure of either student
14 growth or achievement; or a structured district wide student growth goal
15 setting process. The commissioner shall promulgate regulations to imple-
16 ment the provisions of this subdivision.
17 § 2. This act shall take effect immediately.
