        Introduced  by Sen. SQUADRON -- read twice and ordered printed, and when
          printed to be committed to the Committee on Aging
 
        AN ACT to amend the real property tax law, in  relation  to  eligibility
          for  the  senior  citizen  and persons with disabilities rent increase
          exemption program

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph a of subdivision 1 of section 467-b of the real
     2  property tax law, as amended by chapter 576 of  the  laws  of  1974,  is
     3  amended to read as follows:
     4    a.  "Dwelling  unit"  means that part of a dwelling in which a head of
     5  the household resides and which is subject  to  [either]  the  emergency
     6  housing  rent  control  law or to the rent and rehabilitation law of the
     7  city of New York enacted pursuant to the local  emergency  housing  rent
     8  control  law,  [or]  to  the emergency tenant protection act of nineteen
     9  seventy-four, or to an agreement providing for rent increases  equal  to
    10  or  less  than the amount ordered by a rent guideline board of a partic-
    11  ipating locality; however, where such an  agreement  provides  for  rent
    12  increases  for  certain  years  that  are  based on but greater than the
    13  amount ordered by the rent guideline board of a participating  locality,
    14  such  locality  shall have the authority and discretion, with respect to
    15  those certain years, to provide for the rent increases up  to  or  above
    16  the amount ordered by the rent guideline board of a participating local-
    17  ity;
    18    § 2. Paragraph a of subdivision 1 of section 467-b of the real proper-
    19  ty  tax  law, as added by chapter 689 of the laws of 1972, is amended to
    20  read as follows:
    21    a. "Dwelling unit" means that part of a dwelling in which  a  head  of
    22  the  household  resides  and  which is subject to [either] the emergency
    23  housing rent control law or to the rent and rehabilitation  law  of  the
    24  city  of  New York enacted pursuant to the local law enacted pursuant to
    25  the local emergency housing rent control law, or to an agreement provid-
    26  ing for rent increases equal to or less than the  amount  ordered  by  a

     1  rent guideline board of a participating locality; however, where such an
     2  agreement  provides  for rent increases for certain years that are based
     3  on but greater than the amount ordered by the rent guideline board of  a
     4  participating  locality,  such  locality  shall  have  the authority and
     5  discretion, with respect to those certain years, to provide for the rent
     6  increases up to or above the amount ordered by the rent guideline  board
     7  of a participating locality;
     8    §  3.  This  act shall take effect on the thirtieth day after it shall
     9  have become a law; provided that the amendments to paragraph a of subdi-
    10  vision 1 of section 467-b of the real property tax law made  by  section
    11  one of this act shall be subject to the expiration and reversion of such
    12  section  pursuant  to  section 17 of chapter 576 of the laws of 1974, as
    13  amended, when upon such date the provisions of section two of  this  act
    14  shall take effect.
