AN ACT proposing an amendment to article 2 of the constitution, in
relation to residents of the state of New York's rights to form and
maintain political parties
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Resolved (if the Assembly concur), That article 2 of the
2 constitution be amended by adding a new section 10 to read as follows:
3 § 10. The people of New York shall have a right to form, maintain and
4 join a political party. The term "political party" shall mean any poli-
5 tical organization, which at any of the last three preceding elections
6 for governor, polled at least fifty thousand votes for its candidate for
7 governor. Any candidate for election to public office may receive the
8 nomination of any political party. A candidate for election to public
9 office nominated by a political party may also receive a nomination of
10 any other political party. The name of a candidate for election to
11 public office shall appear on the ballot as many times as there are
12 parties or independent bodies nominating him or her, and there shall be
13 a separate voting and registering device at each location in which such
14 name shall appear. A candidate for public office nominated by more than
15 one political party shall be deemed to have received all votes cast
16 under such candidate's name under all the political parties or independ-
17 ent bodies nominating him or her.
18 § 2. Resolved (if the Assembly concur), That the foregoing amendment
19 be referred to the first regular legislative session convening after the
20 next succeeding general election of members of the assembly, and, in
21 conformity with section 1 of article 19 of the constitution, be
22 published for 3 months previous to the time of such election.
