AN ACT to amend the general business law, in relation to prohibiting
municipalities from banning the sale of fur garments
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section
2 399-aaaa to read as follows:
3 § 399-aaaa. Prohibition on the banning of fur products by munici-
4 palities. 1. For purposes of this section, the following terms shall
5 have the following meanings:
6 (a) "Municipality" shall mean a county, city, town or village located
7 within the state.
8 (b) "Fur" shall mean any animal skin or part thereof with hair, fleece
9 or fur fibers attached thereto, either in its raw or processed state.
10 (c) "Fur garment" shall mean any article of clothing or covering for
11 any part of the body, or any fashion accessory, including but not limit-
12 ed to handbags, shoes, slippers, hats, earmuffs, scarves, shawls,
13 gloves, jewelry, and key chains, that is made in whole or in part of
14 fur.
15 2. It shall be unlawful for any municipality to enact any law, rule or
16 regulation imposing a ban on the sale, offer to sell, display for sale,
17 trading, giving, donation, or otherwise distribution of a fur garment by
18 any means.
19 § 2. This act shall take effect immediately.
