AN ACT to amend the education law, in relation to the requirements for a
license as a professional land surveyor; and providing for the repeal
of certain provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 7206-a of the education law, as added by chapter
2 987 of the laws of 1971, paragraph 3 of subdivision 1 and subdivision 2
3 as amended by chapter 32 of the laws of 1981, paragraph 6 of subdivision
4 1 as amended by chapter 133 of the laws of 1982 and paragraph 8 of
5 subdivision 1 and subdivision 3 as amended by chapter 62 of the laws of
6 1989, is amended to read as follows:
7 § 7206-a. Requirements for a license as a professional land surveyor.
8 1. To qualify for a license as a professional land surveyor, an appli-
9 cant shall fulfill the following requirements:
10 (1) Application: file an application with the department;
11 (2) Education: have received an education, including a bachelor's or
12 higher degree based on a program in land surveying, in accordance with
13 the commissioner's regulations;
14 (3) Experience: [(a) If the applicant has a bachelor's or higher
15 degree, have at least four years in work satisfactory to the board,
16 provided that the board may accept study beyond the bachelor's degree in
17 partial fulfillment of this requirement; or (b) If the applicant has an
18 associate's degree, have at least six years in work satisfactory to the
19 board provided that the board may accept study beyond the associate's
20 degree in partial fulfillment of this requirement] Have practical expe-
21 rience satisfactory to the department and in accordance with the commis-
22 sioner's regulations;
23 (4) Examination: pass an examination satisfactory to the board and in
24 accordance with the commissioner's regulations;

1 (5) Age: be at least twenty-one years of age;
2 (6) Citizenship or immigration status: be a United States citizen or
3 an alien lawfully admitted for permanent residence in the United States;
4 (7) Character: be of good moral character as determined by the depart-
5 ment; and
6 (8) Fees: pay a fee of [two hundred twenty dollars to the department
7 for admission to a department conducted examination and for an initial
8 license, a fee of one hundred fifteen dollars for each reexamination, a
9 fee of] one hundred thirty-five dollars to the department for an initial
10 license [for persons not requiring admission to department conducted
11 examination], and a fee of two hundred ten dollars for each triennial
12 registration period.
13 2. In lieu of the degree [and experience] requirements specified in
14 [subparagraphs] paragraph (2) [and (3)] of subdivision one of this
15 section, [eight years of practical experience in work satisfactory to
16 the board may be accepted, provided that each full year of college study
17 in engineering or land surveying satisfactory to the department may at
18 the discretion of the board be accepted in lieu of one year of the
19 required eight years of experience] an associate's degree in land
20 surveying, or an associate's degree or higher in engineering, math, or
21 related science with credits in land surveying acceptable to the depart-
22 ment.
23 [3. For an identification card as an "intern land surveyor", an appli-
24 cant shall fulfill the requirements of subdivision one of this section,
25 except those in subparagraphs (3) and (5), provided that admission to
26 the examination may be given when the applicant is within twenty credits
27 of the completion of the requirements for the bachelor's or higher
28 degree as prescribed in subparagraph (2) of subdivision one, or has
29 completed the practical experience requirement of subdivision two of
30 this section. The fee for examination and identification card as an
31 "intern land surveyor" shall be seventy dollars and the fee for each
32 reexamination shall be seventy dollars.]
33 2-a. For admittance to the fundamentals of surveying examination, the
34 applicant shall fulfill the education, experience, and examination
35 requirements in accordance with the commissioner's regulations. Upon the
36 successful completion of the examination, an identification card as an
37 "intern land surveyor" shall be issued by the department. The fee for
38 examination qualification and identification card as an "intern land
39 surveyor" shall be seventy dollars.
40 2-b. In lieu of the degree and experience requirements specified in
41 paragraphs two and three of subdivision one of this section, eight years
42 of practical experience in work satisfactory to the department may be
43 accepted, provided that each full year of college study in engineering
44 or land surveying satisfactory to the department may at the discretion
45 of the department be accepted in lieu of one year of the required eight
46 years of experience.
47 § 2. This act shall take effect eighteen months after it shall have
48 become a law; provided, however that subdivision 2-b of section 7206-a
49 of the education law, as added by section one of this act, shall expire
50 8 years after such effective date when upon such date the provisions of
51 such subdivision shall be deemed repealed. Effective immediately, the
52 addition and/or repeal of any rule or regulation necessary for the
53 implementation of this act on its effective date are authorized and
54 directed to be made on or before such effective date.
