        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Local  Government  --
          committee  discharged,  bill amended, ordered reprinted as amended and
          recommitted to said committee
 
        AN ACT to amend chapter 538 of the laws of 1975 incorporating the  South
          Salem Exempt Volunteer Firemen's Benevolent Association, and providing
          for  its  powers  and duties, in relation to the purposes of the South
          Salem Exempt Volunteer Firemen's Benevolent Association and to foreign
          fire insurance premium taxes
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Sections 3 and 7 of chapter 538 of the laws of 1975 incor-
     2  porating the South Salem Exempt Volunteer Firemen's  Benevolent  Associ-
     3  ation,  and  providing for its powers and duties, are amended to read as
     4  follows:
     5    § 3. Purposes. The purposes of such corporation shall be [the  mainte-
     6  nance  of  suitable  headquarters  for,  and  the promotion of fraternal
     7  intercourse among the members of such corporation, the relief,  aid  and
     8  assistance  of such members and their families who are disabled or indi-
     9  gent, and the promotion of the welfare of  the  volunteer  fire  service
    10  within the South Salem Fire District and, if any, the territory provided
    11  with  fire  protection  by  contract  with  such  fire district.] to (a)
    12  promote friendly association for the betterment of the  members  of  the
    13  corporation; (b) provide relief, aid and assistance to those members and
    14  their  families  who  are injured, disabled or indigent; (c) provide for
    15  the health and safety of the members of the  corporation;  (d)  maintain
    16  suitable  headquarters  for  the members of the corporation; (e) promote
    17  and safeguard the welfare of the members of the corporation; (f) enhance
    18  the morale of the members of the corporation  by  providing  social  and
    19  recreational  activities for members of the association; and (g) promote

     1  the volunteer fire service within the territory now served or which  may
     2  hereafter be served by the South Salem Fire Department, Inc.
     3    § 7. Precept for payment of foreign fire insurance premium taxes. Such
     4  corporation  shall  collect  and  there  shall  be  paid to it all taxes
     5  imposed by section [five hundred fifty-three] ninety-one hundred four of
     6  the insurance law for fire department use and benefit, upon premiums for
     7  insurance against loss or damage by fire covering property  situated  in
     8  the South Salem Fire District, in the town of Lewisboro, county of West-
     9  chester,  or  within  any  duly  organized  territory  in which the fire
    10  district is or may be obligated to render fire protection.  The  officer
    11  of said corporation designated by its by-laws to collect and receive the
    12  aforesaid  tax  shall  have  all  the  powers  and be subject to all the
    13  provisions of the insurance law, relating to treasurers of fire  depart-
    14  ments. Such corporation shall also be entitled to receive a share of the
    15  tax imposed by section [five hundred fifty-four] ninety-one hundred five
    16  of  the  insurance law, based upon the business written in the territory
    17  with respect to which it is entitled to  collect  and  receive  the  tax
    18  under  section [five hundred fifty-three] ninety-one hundred four of the
    19  insurance law. Such taxes shall only be used [for the care and relief of
    20  disabled or indigent volunteer and exempt volunteer  firemen  and  their
    21  families]  by the corporation in furtherance of its purpose as set forth
    22  in section three of this act.
    23    § 2. This act shall take effect immediately; provided,  however,  that
    24  the  amendments  to section 7 of chapter 538 of the laws of 1975 made by
    25  section one of this act shall apply to taxes due on premiums received on
    26  and after January 1, 2024.
