        Introduced  by  Sen.  O'MARA -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules  --  recommitted  to
          the  Committee  on  Local Government in accordance with Senate Rule 6,
          sec. 8 -- committee discharged, bill  amended,  ordered  reprinted  as
          amended and recommitted to said committee

        AN ACT to amend the village law and the public officers law, in relation
          to   authorizing   the   village   of  Riverside  to  hire  a  village
          clerk/treasurer and code enforcement officer who is not a resident  of
          such village
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 3-300 of the village law is amended by adding a new
     2  subdivision 30 to read as follows:
     3    30. Notwithstanding any provisions of this chapter or any other gener-
     4  al law, local law, ordinance, or special act, the village board of trus-
     5  tees of the incorporated village of Riverside, Steuben county,  may,  by
     6  resolution,  provide  that the village clerk/treasurer and code enforce-
     7  ment officer of the village of Riverside, Steuben county, need not be  a
     8  resident  of such village, but must be a resident of the county in which
     9  such village is located or an adjoining county within the state  of  New
    10  York.
    11    §  2.  Section 3 of the public officers law is amended by adding a new
    12  subdivision 70 to read as follows:
    13    70. In the village  of  Riverside,  in  the  county  of  Steuben,  the
    14  provisions  of  this  section requiring a person to be a resident of the
    15  political subdivision or municipal corporation of the state for which he
    16  or she shall be chosen or within which his or her official functions are
    17  required to be exercised, shall not prevent a person  from  holding  the
    18  office  of  village  clerk/treasurer and code enforcement officer of the
    19  village of Riverside, provided that such person resides in the county in
    20  which such village is located or an adjoining county within the state of

     1  New York. Provided, however, the  person  performing  the  functions  of
     2  village  clerk/treasurer  and  code  enforcement  officer  in  any other
     3  village shall be a resident of such village, unless  otherwise  provided
     4  by an act of the state legislature.
     5    § 3. This act shall take effect immediately.
