        Introduced by Sens. KRUEGER, AVELLA, BAILEY, HOYLMAN, MONTGOMERY -- read
          twice  and  ordered  printed,  and when printed to be committed to the
          Committee on Higher Education
 
        AN ACT to amend the education law, in relation  to  prohibiting  pharma-
          cists  from  refusing to dispense medication solely for philosophical,
          moral, or religious reasons

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  6810 of the education law is amended by adding a
     2  new subdivision 16 to read as follows:
     3    16. No pharmacist shall refuse to dispense or refill a prescription or
     4  non-prescription drug approved by the U.S. Food and Drug  Administration
     5  for  restricted distribution by pharmacies solely on the grounds that to
     6  dispense or refill  the  prescription  or  non-prescription  drug  would
     7  contravene the pharmacist's philosophical, moral, or religious beliefs.
     8    § 2. This act shall take effect on the first of November next succeed-
     9  ing the date on which it shall have become a law.
