AN ACT to amend the education law, in relation to requiring schools to
provide instruction in cardiopulmonary resuscitation
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 804-c of the education law, as added by chapter 269
2 of the laws of 1999, is amended to read as follows:
3 § 804-c. Cardiopulmonary resuscitation instruction. 1. Instructions
4 regarding cardiopulmonary resuscitation [may] shall be [offered for
5 voluntary admission as] a part of the health education or physical
6 education curriculum in all senior high schools. Instruction in
7 cardiopulmonary resuscitation may be limited to psychomotor skill
8 instruction and may include the completion of a certified course, howev-
9 er student certification shall not be mandatory to meet the requirements
10 of this section. In addition to the requirement that all teachers of
11 health education shall be certified to teach health, persons instructing
12 pupils in cardiopulmonary resuscitation shall possess valid certif-
13 ication by an agency offering such certification in the performance of
14 cardiopulmonary resuscitation [and in its instruction]. For the
15 purposes of this section, "psychomotor skill" shall mean the use of
16 hands only practicing to support cognitive learning.
17 2. The commissioner [may] shall prescribe regulations governing such
18 health education and physical education courses which shall include
19 instruction in cardiopulmonary resuscitation. Such regulations shall in
20 no event prescribe a course of study in cardiopulmonary resuscitation
21 which sets forth standards for psychomotor skill instruction of a lesser
22 quality than [the requirements of the programs adopted by the American
23 Heart Association or the American Red Cross] accepted standards in the
24 United States.
25 3. School authorities [that choose to offer such course] shall provide
26 the needed facilities, time and place for the instruction set forth
27 herein and shall provide learning aids and curriculum resource materials
28 to support such course of study.

1 § 2. Section 804-d of the education law, as added by chapter 315 of
2 the laws of 2005, is amended to read as follows:
3 § 804-d. Automated external defibrillator instruction. Instructions
4 regarding the correct use of an automated external defibrillator shall
5 be included as a part of the health education or physical education
6 curriculum in all senior high schools when cardiopulmonary resuscitation
7 instruction is being provided as authorized by section eight hundred
8 four-c of this article. In addition to the requirement that all teach-
9 ers of health education shall be certified to teach health, persons
10 instructing pupils in the correct use of automated external defibrilla-
11 tors shall possess valid certification by a nationally recognized organ-
12 ization or the state emergency medical services council offering certif-
13 ication in the operation of an automated external defibrillator [and in
14 its instruction].
15 § 3. This act shall take effect June 30, 2015. Effective immediately,
16 the commissioner of education is authorized to promulgate any rule or
17 regulation necessary for the timely implementation of this act on its
18 effective date.
