          printed to be committed to the Committee on Rules
 
        AN ACT to amend the administrative code of the city of New York and  the
          vehicle and traffic law, in relation to requiring the city of New York
          to establish the New York city school safety fund

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 19-904 of the administrative code of  the  city  of
     2  New York is amended by adding a new subdivision f to read as follows:
     3    f. 1. The city shall establish a fund to be known as the New York city
     4  school  safety  fund.  Any fines or monies collected pursuant to section
     5  19-903 of this chapter, except  for  any  monies  pending  a  proceeding
     6  before  OATH,  shall  be deposited into such fund. Upon a final determi-
     7  nation of a proceeding before OATH, any fines or monies required  to  be
     8  paid by the liable party shall be deposited into such fund.
     9    2. Monies of the fund shall be available to the chancellor of the city
    10  school district of the city of New York, the commissioner of transporta-
    11  tion, and the police commissioner to fund school initiatives relating to
    12  the  safe  travel  of  students,  including  but not limited to, funding
    13  crossing guards, maintaining crosswalks, adding  and  maintaining  side-
    14  walks, installing stop signs, and upgrading infrastructure around school
    15  property.
    16    3.  Monies  of the fund shall not be transferred into the general fund
    17  of the city. Such monies shall  only  be  borrowed  for  other  purposes
    18  relating to the city only upon approval from the state legislature.
    19    §  2.  Section  1174 of vehicle and traffic law is amended by adding a
    20  new subdivision (c-1) to read as follows:
    21    (c-1) Notwithstanding any other provision of law to the contrary,  any
    22  fines  or  monies collected in cities having a population of one million
    23  or more pursuant to subdivision (c) of this section shall  be  deposited
    24  into the New York city school safety fund established pursuant to subdi-

     3    §  3.  This act shall take effect immediately, provided, however, that
     4  the amendments to section 19-904 of the administrative code of the  city
     5  of  New York made by section one of this act shall not affect the repeal
     6  of such section and shall be deemed repealed therewith.
