        AN ACT to amend the public authorities law, in relation to the financing
          and construction of facilities by the dormitory authority  for  Summit
          Educational Resource, Inc., of Western New York

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (b) of subdivision  2  of  section  1676  of  the
     2  public authorities law is amended by adding a new undesignated paragraph
     3  to read as follows:
     4    Summit Educational Resource, Inc., of Western New York, a not-for-pro-
     5  fit  organization,  for  the  acquisition, financing and/or refinancing,
     6  design, construction, renovation, reconstruction, development,  improve-
     7  ment, furnishing, expansion and/or equipping of a facility or facilities
     8  and necessary ancillary and related facilities.
     9    §  2.  Subdivision  1 of section 1680 of the public authorities law is
    10  amended by adding a new undesignated paragraph to read as follows:
    11    Summit Educational Resource, Inc., of Western New York, a not-for-pro-
    12  fit organization, for the  acquisition,  financing  and/or  refinancing,
    13  design,  construction, renovation, reconstruction, development, improve-
    14  ment, furnishing, expansion and/or equipping of a facility or facilities
    15  and necessary ancillary and related facilities.
    16    § 3. Any contracts entered into by the dormitory authority pursuant to
    17  this act shall be deemed state contracts within the meaning of that term
    18  as set forth in article 15-A of the executive  law,  and  Summit  Educa-
    19  tional Resource, Inc., of Western New York shall be deemed, for purposes
    20  of this act, a contracting agency as that term is used in such article.
    21    § 4. This act shall take effect immediately.
