        Introduced  by Sens. MARTINEZ, GAUGHRAN -- read twice and ordered print-
          ed, and when printed to be committed to the Committee on Rules
 
        AN ACT to amend the public health law, in relation to establishing a cap
          on the price of prescription insulin
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  public health law is amended by adding a new section
     2  280-d to read as follows:
     3    § 280-d. Prescription insulin price  cap.  1.  For  purposes  of  this
     4  section,  "prescription  insulin  drug"  shall  mean a prescription drug
     5  containing insulin to be used in the treatment of diabetes and that:
     6    (a) is required by any applicable federal or state law to be dispensed
     7  only pursuant to a prescription; or
     8    (b) is restricted by any applicable federal or state  law  to  use  by
     9  practitioners only.
    10    2.   Any   health   insurance   carrier  that  provides  coverage  for
    11  prescription insulin drugs pursuant to the terms of a  health  insurance
    12  policy or health benefits plan shall cap the total cost a covered person
    13  is  required to pay for a covered prescription insulin drug at an amount
    14  not to exceed one hundred dollars per  thirty  day  supply  of  insulin,
    15  regardless  of the amount or type of insulin needed to fill such covered
    16  person's prescription.
    17    3. Nothing in this section shall prevent a  health  insurance  carrier
    18  from  reducing  a covered person's cost for insulin by an amount greater
    19  than the amount specified in subdivision two of this section.
    20    § 2. This act shall take effect immediately.
