        Introduced  by  Sen.  HANNON -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the social services law, in relation to medical  assist-
          ance  payments  for clinical services provided to persons with a trau-
          matic brain injury

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  (e)  of  subdivision 1 of section 367-a of the
     2  social services law, as amended by section 41 of part D of chapter 56 of
     3  the laws of 2012, is amended to read as follows:
     4    (e) Amounts payable under this title for  medical  assistance  in  the
     5  form  of  clinic services pursuant to article twenty-eight of the public
     6  health law and article sixteen of the mental  hygiene  law  provided  to
     7  eligible persons diagnosed with a developmental disability or a traumat-
     8  ic  brain  injury who are also beneficiaries under part B of title XVIII
     9  of the federal social security act, or  provided  to  persons  diagnosed
    10  with  a  developmental  disability  or  a traumatic brain injury who are
    11  qualified medicare beneficiaries under part B of title XVIII of such act
    12  shall not be less than the approved  medical  assistance  payment  level
    13  less the amount payable under part B.
    14    § 2. This act shall take effect immediately.
