AN ACT to amend the vehicle and traffic law, in relation to refunds of
the vehicle registration fees
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1-a of section 428 of the vehicle and traffic
2 law, as added by section 76-a of part A of chapter 56 of the laws of
3 1998, is amended to read as follows:
4 1-a. Notwithstanding the provisions of subdivision one of this
5 section, if a registration is issued for a period of not less than two
6 years pursuant to paragraph c of subdivision five of section four
7 hundred one of this [chapter] title, the registration fee paid for the
8 period commencing after the [first twelve month period of such registra-
9 tion shall be refunded less the sum of one dollar provided the number
10 plates are surrendered to the commissioner before the end of the first
11 twelve month period of such registration and application therefor is
12 filed with the commissioner within two months from the expiration of the
13 first twelve month period of such registration] number plates are
14 surrendered to the commissioner or, in the case of a stolen vehicle,
15 upon submission of documentation satisfactory to the commissioner, there
16 shall be refunded to the owner a sum equal to as many twenty-fourths of
17 the fee paid for the registration of the vehicle as there are full
18 calendar months in the registration period following the date of the
19 receipt of the number plates or plate or the filing of an application
20 for a refund if no plates are available, less the sum of one dollar.
21 § 2. Subdivision 3 of section 428 of the vehicle and traffic law, as
22 amended by chapter 262 of the laws of 1969, is amended to read as
23 follows:
24 3. Where a refund of any part of a registration fee is made pursuant
25 to [the foregoing provisions] subdivision one, one-a, one-b or two of
26 this section, the registration shall thereupon be automatically
27 cancelled.
28 § 3. This act shall take effect on the ninetieth day after it shall
29 have become a law.
