        Introduced  by  Sen. MARTINS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Crime Victims,  Crime  and
          Correction
 
        AN  ACT  to  amend  the  executive  law, in relation to the placement of
          level-two and level-three sex offenders in hotels and motels
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section  1.    Section 243 of the executive law is amended by adding a
     2  new subdivision 5 to read as follows:
     3    5. No placement made pursuant to  subdivision  four  of  this  section
     4  shall  be  made if the governing body of the county, town, or village in
     5  which the level-two or level-three sex offender is to be placed,  adopts
     6  a resolution prohibiting such placement where such placement would be in
     7  any  hotel,  motel,  or  other  class  B multiple dwelling as defined in
     8  subdivision nine of section four of the multiple dwelling law, and  such
     9  dwelling is also housing one or more additional level-two or level-three
    10  sex offender.
    11    §  2.  This  act shall take effect on the ninetieth day after it shall
    12  have become a law.
