        Introduced  by  Sen.  LANZA  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the penal law, in relation to establishing the  class  C
          felony  of  assault  of  a patient in a mental health or developmental
          disability facility

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The penal law is amended by adding a new section 120.05-a
     2  to read as follows:
     3  § 120.05-a Assault of a patient in  a  mental  health  or  developmental
     4               disability facility.
     5    A  person  is  guilty  of  assault  of a patient in a mental health or
     6  developmental disability facility when with  intent  to  cause  physical
     7  injury  to a patient residing in a facility operated, licensed or certi-
     8  fied by the office of mental health or the office for people with devel-
     9  opmental disabilities, he or she causes such injury to such person.
    10    Assault of a patient in a mental health  or  developmental  disability
    11  facility is a class C felony.
    12    § 2. This act shall take effect on the first of November next succeed-
    13  ing the date on which it shall have become a law.
