        Introduced  by  Sens. GRIFFO, LAVALLE -- read twice and ordered printed,
          and when printed to be committed to the Committee on Rules --  commit-
          tee  discharged, bill amended, ordered reprinted as amended and recom-
          mitted to said committee
 
        AN ACT to amend the vehicle and traffic law, in relation to  restricting
          driving in a passing lane without overtaking or passing a vehicle
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. This act shall be known and may be cited as the "failure to
     2  pass act".
     3    § 2. Section 1122 of the vehicle and traffic law is amended by  adding
     4  a new subdivision (c) to read as follows:
     5    (c)  When  driving  on  an  interstate highway, no motor vehicle shall
     6  drive for more than one and one-half miles in a  passing  lane  if  such
     7  vehicle is not overtaking or passing a vehicle pursuant to this section.
     8  Notwithstanding  15 NYCRR Part 131 or any other law, rule, or regulation
     9  to the contrary, a violation of this subdivision shall not constitute  a
    10  lane  violation  in  accordance  with  the  regulatory  authority of the
    11  commissioner. A violation of this subdivision shall be punishable  by  a
    12  fine of fifty dollars for the first offense and by a fine of one hundred
    13  dollars for each subsequent offense.
    14    § 3. This act shall take effect immediately.
