        Introduced  by  Sen.  BROOKS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes
 
        AN ACT to amend the penal law, in relation to the forgery  of  immuniza-
          tion records
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 5 of section 170.10 of the penal law is amended
     2  and a new subdivision 6 is added to read as follows:
     3    5. A prescription of a duly licensed physician or other person author-
     4  ized to issue the same for any drug or any instrument or device used  in
     5  the  taking  or  administering  of  drugs  for  which  a prescription is
     6  required by law[.]; or
     7    6. An immunization record  produced  by  a  federal,  state  or  local
     8  government   health  organization  indicating  that  an  individual  has
     9  received immunizations as stated therein, including but not  limited  to
    10  the  COVID-19  vaccination  record card approved by the U.S. centers for
    11  disease control.
    12    § 2. Subdivision 2 of section 170.15 of the penal law is amended and a
    13  new subdivision 3 is added to read as follows:
    14    2. Part of an issue of stock, bonds or other instruments  representing
    15  interests  in or claims against a corporate or other organization or its
    16  property[.]; or
    17    3. Fifty or more immunization records produced by a federal, state  or
    18  local  government  health organization indicating that an individual has
    19  received immunizations as stated therein, including but not  limited  to
    20  the  COVID-19  vaccination  record card approved by the U.S. centers for
    21  disease control.
    22    § 3. This act shall take effect immediately.
