        Introduced  by  Sen.  SAVINO -- read twice and ordered printed, and when

        AN  ACT  to  amend  the  public health law, in relation to emergency and
          non-emergency transportation of medical assistance recipients
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  public health law is amended by adding a new section
     2  3005-c to read as follows:
     3    § 3005-c. Emergency  and  non-emergency  transportation   of   medical
     4  assistance  recipients.  1.  For  purposes of this section the following
     5  terms shall have the following meanings:
     6    (a) "Emergency medical transportation" shall mean  transportation  for
     7  the  purpose  of  obtaining  hospital  services for a medical assistance
     8  recipient who suffers from severe, life-threatening or potentially disa-
     9  bling conditions which requires emergency medical services,  as  defined
    10  in  subdivision one of section three thousand one of this article, while
    11  the recipient is being transported.
    12    (b) "Non-emergency medical transportation" shall  mean  transportation
    13  for  the  purpose  of  obtaining necessary medical care or services to a
    14  medical assistance recipient.
    15    2. Any  emergency  medical  transportation  or  non-emergency  medical
    16  transportation of a medical assistance recipient shall be provided by an
    17  individual,  partnership,  association, corporation, municipality or any
    18  legal public entity or subdivision thereof by  means  of  transportation
    19  vehicles  that are directly owned or leased by said individual, partner-
    20  ship, association, corporation, municipality or any legal public  entity
    21  or  subdivision  thereof.  With  the exception of municipal fire depart-
    22  ments, such transportation may not be assigned,  delegated,  or  subcon-
    23  tracted  to  third  parties.  Such  vehicles  shall  be  maintained  and
    24  inspected in accordance with rules promulgated by the commissioner.
    25    § 2. This act shall take effect immediately.
